DescriptionLegal papers including bills, briefs, answers, directions, reports, affidavits, petitions, orders, schedules, leases and agreements relating to affairs of the trust set up under the will of Sir Robert Holt Leigh [d 1843]. Papers relate to Chancery suits concerning the lease of mines and properties managed by the trust, and the appointment of replacement trustees. There are also papers relating to the management of trust properties, and the acquisition of new properties. Trust properties include land and dwellings in Aspull and Orrell, Wigan, and Ince, Cheshire.

Cases include:

Bill filed in Chancery 12th Jan 1846 by Thomas Pemberton Leigh, 1st Baron Kingsdown, Barrister, Lincoln's Inn, of Middlesex. Defendants: James Earl of Balcarres, Henry Gaskell, Loveday Cooke, Roger Yates, John Radcliffe and his wife Anne, Frances Pemberton, Mary Leigh and Isaac Ellison [fellow trustees]. The case was brought to establish whether the terms of Holt Leigh's will allowed for the issue of new leases of coal mines on the estate by the trustees during the lifetime of Loveday Cooke [main beneficiary of Holt Leigh]. The suit was then brought to the Court of Common Pleas. A certificate was issued 3rd May 1848. An order was issued by Vice Chancellor Wigram on 12th May 1848 granting power to the trustees to lease new mines.

Thomas Pemberton Leigh v Edward Owen Pemberton, James Horden, Mary Owen, Sir John Croft, and Anne Knox. Chancery suit levied to appoint replacement trustees in consequence of deaths of Frances Pemberton and Anne Radcliffe in 1848.

Chancery suit levied by Thomas Pemberton Leigh, 1849 in matter of Ac1 Wm 4c 60, and to replace Henry Gaskell with another trustee on the grounds of insanity. Defendants: James Earl of Balcarres, Henry Gaskell, Loveday Cooke, Roger Yates, John Radcliffe and his wife Anne, Frances Pemberton, Mary Leigh and Isaac Ellison [fellow trustees]. Defendants: Edward Owen Pemberton, James Horden, Mary Owen, Sir John Croft, and Anne Knox. Chancery suit levied in light of deaths of Frances Pemberton and Anne Radcliffe.

Leasees include the Kirkless Hall Coal Co.
